The petitioner seeks bail in Sherghati P.S. case No. 343 of 2015 under Section 387 and other Sections of the Indian Penal Code and under Section 17 of C.L.A. Act. The informant, S.H.O. of Sherghati P.S., got information that some extremists set ablaze cable drum meant for electrification.
The learned counsel for the petitioner submits that villagers are said to have disclosed the name of the petitioner. The petitioner has falsely been implicated in the case. The informant did not disclose the name of any of the villager, who disclosed the name of the petitioner. Similarly situated accused, namely, Uttam Kumar and Birbal Das have already been granted bail and the case
Patna High Court Cr.Misc. No.39881 of 2016 (3) dt.01-12-2016 2/2 of petitioner stands on the same footing. The petitioner is in jail since 28.04.2016.
Considering the facts aforesaid and the fact that petitioner has already remained in jail for more than six months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya in Sherghati P.S. Case No. 343 of 2015.
