2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 467 , 468 , 469, 471 and 34 of the Indian Penal Code.

3. On a secret information a raid was conducted by the police party in the shop of the petitioner, where other coaccused persons were making duplicate Aadhar Card.

4. It is submitted on behalf of the petitioner that the name of the petitioner transpired on the confessional statement of other co-accused persons who were apprehended at the spot. No incriminating material has been recovered from the

Patna High Court CR. MISC. No.54731 of 2023(2) dt.28-08-2023 2/2 conscious possession of the petitioner and he is no way connected with the alleged occurrence. From bare perusal of the F.I.R, it is apparent that the allegation of making forged aadhar card is on other co-accused persons, as such, no allegation is made out against the petitioner.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A . C . J . M. IInd, Muzzaffarpur, West in connection with Motipur P.S. case no. 73 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
