The petitioner apprehends his arrest in Complaint Case No. 437/2014, registered for the offences punishable under Section 498A and other Sections of the Indian Penal Code. The petitioner is ready to keep his wife.
Learned counsel for the complainant has also submitted that the complainant is ready to live with her husband, as she got two children and she has got no other scope to live. Considering the facts aforesaid and the fact that both the husband and wife are ready to live with each other, the petitioner
Patna High Court Cr.Misc. No.23447 of 2015 (2) dt.08-07-2015 2/2 above named is directed to surrender in the court below within one month from the date of receipt/production of a copy of this order and on such the court below shall enlarge the petitioner on provisional bail, after issuing notice to the complainant, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Patna City in connection with Patna Complaint Case No. 437/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and thereafter the husband and wife shall appear in Court on 3rd August, 2015 and the learned court below shall make efforts to resolve the dispute between the husband and wife and if the dispute is amicably settled, the provisional bail granted to the petitioner shall be confirmed and if the dispute does not resolve the court below shall pass order in accordance with law on the provisional bail of the petitioner.
