JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-09-2018 The petitioners seek bail in connection with Budha Colony P.S. Case No. 185 of 2018, registered for offences punishable under Sections 401 of the Indian Penal Code. Prosecution case is that police on informant that some persons have assembled to commit a dacoity, raided the place and arrested the petitioners and other accused and recovered screw driver and other articles.

It has been submitted on behalf of the petitioners that they have been made accused in this case only on the basis of suspicion and except that there is nothing in this case and they have been in custody since 23.05.2018 and although they are accused in two more cases but in both the cases, they are on bail. Heard learned A.P.P. also.

No.57921 of 2018 (2) dt.28-09-2018 2/2 Considering the aforementioned facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000, (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM - XVI, Patna, in connection with Budha Colony P.S. Case No. 185 of 2018, with following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of their bail bonds.
