The petitioners are apprehending their arrest in a case registered under Sections 406, 420 and 34 of the Indian Penal Code.

The prosecution case, in short, is the accused persons misappropriated the government money, meant for different government schemes.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been made accused due to mistake of fact. The work assigned to the petitioners has already

Patna High Court Cr.Misc. No.56800 of 2018(2) dt.08-10-2018 2/2 been completed. It is further submitted that the petitioners are ready to jointly deposit a sum of Rs. Two lakhs in the court below subject to the final disposal of the case. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, on deposit of a sum of Rs. Two lakhs jointly in the Court below which shall subject to final disposal of the cas e , let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri G.N. Dubey, Judicial Magistrate, Gaya in connection with Amas P.S. Case No. 239/17, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
