Having regard to the nature of allegation for offence under sections 406, 369, 302, 109 of the Indian Penal Code and the fact that the police case was lodged against the petitioner in the year 2009, this Court must direct the petitioner to first surrender and make a prayer for regular bail and is not inclined to grant privilege of anticipatory bail to the petitioner who despite being named in the F.I.R. as an accused has remained out of reach of the police. That being so, if the petitioner surrenders within a period of four weeks from today, his prayer for regular bail shall be considered on the basis of material in the case diary and without being prejudiced by this order.

With the aforementioned observations, this application is disposed of.
