The petitioner seeks bail in Kudra P.S. Case No. 309/2018, instituted for the offence under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. There is no recovery of alleged motorcycle from his conscious possession. Police has implicated the petitioner in this case merely on suspicion. Petitioner is in custody since 28.07.2018. He has clean antecedent.

Seizure-list is part of F.I.R. wherein it is mentioned that motorcycle was recovered from the road in front of Gita Ghat

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Kaimur at Bhabhua in connection with Kudra P.S. Case No. 309/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
