The petitioner seeks bail in Kasba P.S. Case No. 339 of 2018, instituted for the offence under Section(s) 392 of the Indian Penal Code. Subsequently Section 411 of the Indian Penal Code was added.

It is alleged in the written report that informant being the employee of Kasba Fuel Center was going to deposit cash of Rs. 14,77,000/- in the bank, but in the way, money was robbed by some miscreants.

Counsel for the petitioner submits that petitioner is not named in the written report. The Police arrested petitioner on suspicion and recorded his confessional statement. He further submits that other co-accused have already been

Patna High Court CR. MISC. No.50196 of 2019(2) dt.17-08-2019 2/2 granted bail by coordinate Bench of this Court vide order dated 28.5.2019 passed in Cr. Misc. 34739 of 2019.

The learned Sessions Judge has mentioned in the impugned order that Rs.2,92,000/- has been recovered from house of the petitioner. But there is no Test Identification Parade of the aforesaid note recovered from house of the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Kasba P.S. Case No. 339 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
