Petitioner prays for bail in connection with Gopalganj Nagar P.S.Case No. 257 of 2018 registered for the offences punishable under Sections 406, 420, 467, 468, 471 and 120B/34 of the Indian Penal Code.

Allegation as per FIR is that petitioner has taken agriculture loan against ornaments, which were found to be fake. Submission of learned counsel for the petitioner is that ornaments were examined by the valuer of the Bank who has found the same as genuine and thereafter the allegation has been made. Further submission is that out of Rs.3 lakhs he has deposited Rs.43,000/- and he is ready to deposit rest of Rs.2.57 lakhs if he is granted some reasonable time.

Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to deposit Rs.57,000/- through a Bank Draft payable to the Bank in court and in that event petitioner shall be released on provisional bail for a period of four months on the condition that petitioner will continue to pay the rest amount of Rs.200000/- in four equal instalments in first week of the next following months and on failure to deposit any of the instalments, his bail bond shall be cancelled. It is made clear that once the total amount is deposited, his bail bond shall be confirmed and the aforesaid deposit will be subject to return of the ornaments deposited by the petitioner.
