This Interlocutory Application has been filed by the petitioner, under Section 5 of the Limitation Act, seeking condonation of delay of two years seven months and 17 days in preferring the present review petition against the order, dated 27.08.2012, passed by a Division Bench of this Court in L.P.A. No. 1126 of 2012.

Heard Mr. Kumar Brijnandan, learned Counsel, appearing for the petitioner, and Mr. Nikesh Kumar, learned Counsel, appearing for the respondents.

Having considered the reasons assigned in the present petition seeking condonation of delay and having heard

No.127 of 2015 (2) dt.09-09-2015 2/2 the learned counsel for the parties concerned, this Court is satisfied that the petitioner was prevented by sufficient causes from preferring the review petition within time. In view of the above, the delay in preferring the review petition is hereby condoned.

I.A. No. 5852 of 2015 stands disposed of.

C. Rev. No. 127 of 2015:

After some arguments, Mr. Kumar Brijnandan, learned counsel for the petitioner seeks permission to withdraw this petition with liberty to approach the appropriate authority with appropriate application, if so advised, and also to take recourse to such provisions of law as may be permissible. No objection has been raised to the prayer for withdrawal made by the petitioner.

In view of the above and in the interest of justice, the review petition is hereby disposed of as withdrawn with liberty granted to the petitioner to approach the appropriate authority with appropriate application, if so advised, and also to take recourse to such provisions of law as may be permissible.
