2. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 30(a)/32/36/41 of the Bihar Prohibition and Excise Act.

3. As per the prosecution, total recovery of 2358 liter wine is the subject matter of the present case from a truck lorry.

4. Counsel for the petitioner submits that petitioner is innocent and he was not apprehended from the place of occurrence. He submits that the name of the petitioner has come in this case by virtue of the confessional statement of the driver. He further submits that being the owner of the truck petitioner is completely unaware of the what his driver has done.

5. Learned APP for the State opposes the prayer for bail.

6. In the present facts and circumstances, I am not inclined to grant bail to the petitioner.
