JUSTICE SHAILENDRA SINGH ORAL ORDER 02-09-2025 The instant writ petition has been filed seeking the relief of issuance of a writ in the nature of Mandamus to direct the learned Deputy Collector Land Reforms (DCLR), West Muzaffarpur, to release the amount of Rs. 3,36,600/- (Rupees Three Lakhs Thirty Six Thousand Six Hundred) which has been deposited by the petitioner through Challan No. 25 dated 20.05.2016 under the provision of the Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, in connection with Pre-Emption Case No. 01 of 2016-17 on 24.05.2016.

2. It is submitted by petitioner's counsel that the said Pre-Emption Case No. 01 of 2016-17 was dismissed by the

Patna High Court CWJC No.13754 of 2025(3) dt.02-09-2025 2/2 DCLR, West Muzaffarpur, but he failed to pass any order regarding the refund of the said deposited amount with interest. Further, in the Ceiling Appeal Case No.01 of 2017/18, preferred by the petitioner, the appellate authority also did not give any direction to refund the said amount of Rs. 3,36,600/- in favour of the petitioner.

3. Learned counsel appearing for the StateRespondent No. 2 has no opposition to the aforesaid submission.

4. As the prayer made by the petitioner to refund the deposited amount of Rs. 3,36,600/- has not been opposed by the Respondent No. 2, hence, the DCLR, West Muzaffarpur, is directed to refund the said deposited amount to the petitioner within two weeks from the date of receipt of a copy of this order, as per the provisions of law.

5. With the above direction, the writ petition stands disposed of.
