The petitioner is apprehending arrest in a case registered for the offences punishable under Section 364(A) of the IPC. The accusation is of kidnapping the son of the informant. It is submitted by learned counsel for the petitioner that the victim, in his 164 Cr. P.C. statement, has not alleged anything against the petitioner.

Considering the fact that the impugned order suggests that the chargesheet has been submitted declaring the petitioner an absconder, this court is not inclined to grant privilege of anticipatory bail to the petitioner.

However, learned Court below may consider the prayer for

Patna High Court CR. MISC. No.48165 of 2019(2) dt.02-08-2019 2/2 regular bail of the petitioner, if he surrenders within a period of six weeks in connection with Sahebganj P.S. Case No. 369 of 2018, learned Sub-Judge-1st-cum-ACJM-1st, (West), Muzaffarpur.
