15-12-2016 Heard Sri Anish Kumar, learned counsel for the petitioner and Dr. Ajit Kumar, learned Addl. Public Prosecutor. The sole petition, who is in custody since 14-05-2016 in Motipur P.S. Case No. 133 of 2016 registered for offence under Sections 399, 402, 414 of the Indian Penal Code, Sections 25(1b)a, 26(ii), 35 of the Arms Act, 1959 and Sections 20 & 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated on an allegation of assembling and preparing for committing dacoity. He submits that save and except recovery of Ativan tablets from the possession of the petitioner, all other materials were recovered from other

Patna High Court Cr.Misc. No.44267 of 2016 (2) dt.15-12-2016 2/2 accused persons.

However, on perusal of the F.I.R., it is evident that alongwith the petitioner, other accused persons were also arrested, from whom, country-made pistol, cartridges besides sedative drugs were recovered.

Considering the seriousness of the accusation, I do not find any ground to grant bail.

Dismissed.
