Learned counsel for the petitioner is directed to implead the District Magistrate, Vaishali at Hajipur as party respondent no.5.

In this case, the petitioner is seeking limited relief that he is entitled to 3% increment in his pay in the last year of his service, but the same has been refused to be granted on account of fact that he could not cross the hurdle of computer skill test.

The State has attached the notification dated

Patna High Court CWJC No.4134 of 2017 dt.07-09-2018 2/2 29.05.2011, which prescribes the person who has attended the age of 50 years, in fit case will be granted exemption. As the petitioner is at the verge of retirement could not clear the computer skill test, he has filed an application for grant of exemption having been recommended by his superior officers.

Let the District Magistrate, Vaishali, Hajipur, consider the case of the petitioner with regard to exemption from passing the computer skill test and grant of benefit of 3% increment in his pay and take decision in accordance with law considering the fact that the petitioner at the verge of his retirement. The District Magistrate, shall complete the entire exercise within a period of three months from the date of receipt/production of a copy of this order.

With the aforesaid observations and directions, this writ petition is disposed of.
