26-05-2021 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Raniganj P.S. Case No. 291 of 2020, registered for the offence under Section 392 of the Indian Penal Code.
As per the prosecution case, while the informant, after collecting cash of Rs. 1,30,545/- on eight centres on a motorcycle, reached near the house of one Jitendra Paswan, four unknown miscreants intercepted him and thereafter, threw chilly powder into the eyes of informant and snatched mobile phone, aforesaid cash amount, one Samsung Tablet and motorcycle of the informant. It is further alleged that several villagers, who gathered there, disclosed the name of co-accused Gamgam Jha, as one of the miscreant, who is involved in the alleged

Petitioner is not named in the F.I.R. and only on suspicion, petitioner has been arrested and till date, the petitioner has not been put on T.I.P. Petitioner claims clean antecedent and he is in custody since 04.10.2020. However, learned A.P.P. for the State opposed the bail application and submitted that looted motorcycle of the informant was recovered from the house of the petitioner. Considering the aforesaid facts and circumstances as well as submissions advanced on behalf of the parties and the fact that looted motorcycle has been recovered from the house of petitioner, the bail application of petitioner is rejected.
