The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 114, 323, 324, 341, 354(c), 376, 377, 386, 406, 420, 493, 494, 506/34 of the Indian Penal Code.

The prosecution case in nutshell is that petitioner came in contact with the informant through internet and after developing intimacy petitioner went to the house of informant at Assam. It is further alleged that petitioner put vermilion over the head of informant and without the her

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that informant was a divorcee lady and the petitioner after being deserted by his wife, they both decided to live jointly. It is further submitted that the petitioner came to know that the informant was having connections with various persons to whom she was in frequent contact. Petitioner tried to persuade her but when she continued her relationship with those persons, bone of contention arose between them. It is submitted vide para 9 of the petition that the informant left the place of petitioner and also lodged a case in Assam. Informant was living with the petitioner with her own free will and as per report of the medical board, there is no sign of physical or internal injury. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Triveniganj P.S. Case No. 180 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 1st, Supaul.
