The petitioners apprehend their arrest in connection with Inarwa P.S. Case No. 56 of 2020 registered under Sections 147, 148, 341, 323, 324, 307, 337, 338, 504 and 506 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Petitioner no.1 is aged about 80 years. There is no specific allegation against the petitioners.
Patna High Court CR. MISC. No.7664 of 2021(4) dt.22-10-2021 2/2 Learned A.P.P. appearing on behalf of the State opposed the prayer of petitioner nos. 2 and 4 by contending that there is specific allegation against them. Hence, petitioner nos. 2 and 4 do not deserve anticipatory bail.
Having considered the above facts and circumstances of the case, prayer of the petitioner nos. 2 and 4 for grant of anticipatory bail is rejected.
Insofar as prayer of petitioner nos. 1 and 3 are concerned, their prayer for grant of anticipatory bail is allowed. Let the above named petitioner nos. 1 and 3 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-II, Bettiah, West Champaran in connection with Inarwa P.S. Case No. 56 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
