Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 337, 324 and 504/34 of the Indian Penal Code and Sections 37(b)(c) of the Bihar Excise Prohibition Amendment Act, 2018. It is a case of assaulting and abusing to the informant and during occurrence, informant Guddu Kumar sustained injury which inflicted as alleged by co-accused Vivek Kumar. It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.62099 of 2021(4) dt.27-07-2022 2/2 that the petitioners have falsely been implicated in this case. He further submits that there is general and omnibus allegation against them and specific allegation of assault is against coaccused Vivek Kumar and not against these petitioners and the injuries are simple in nature. Petitioners have no criminal antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge-cum-Special Judge, Excise Court, Aurangabad in connection with Kutumba P.S. Case No. 94 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
