2. The petitioner has prayed for regular bail in connection with Mahkar P.S. Case No. 66 of 2024 instituted for the offence under Sections 147, 148, 149, 448, 341, 342, 323, 307, 302, 504, 506 and 120B of the Indian Penal Code and Sections 3 and 4 of the Bihar Dian Adhiniyam, 1999.

3. Earlier, the bail petition of the petitioner was rejected by this Court vide order dated 18.01.2025 in Cr. Misc. No. 61437 of 2024.

4. Learned counsel for the petitioner submits that certain accused persons having similar nature of allegations have been granted pre-arrest bail by learned co-ordinate Bench

Patna High Court CR. MISC. No.51925 of 2025(2) dt.01-08-2025 2/3 and from this Court respectively vide Cr. Misc. Nos. 67299 of 2024 and 15284 of 2025 as against this, learned counsel for the informant has submitted that the regular bail of three other accused persons having similar nature of allegation have been rejected by a learned co-ordinate Bench of this Court vide order dated 02.07.2025 in Cr. Misc. No. 89050 of 2024.

5. Learned counsel for the petitioner has submitted that petitioner is in judicial custody since 01.04.2024.

Learned counsel for the informant has submitted that the accused persons who have been granted pre-arrest bail by learned co-ordinate Bench as well as from this Court were not having any specific allegation whereas the case of this petitioner stands on similar footing with those accused persons whose bail has been rejected by learned co-ordinate Bench.

7. Having heard learned counsel for the parties and from perusal of the FIR, it is clear that after beating the deceased badly, the petitioner along with others locked him in Anganwadi Kendra where he succumbed to his injuries. The name of this petitioner finds place in the group of the persons who were involved in locking the deceased in Anganwadi Kendra. No new material has been brought before this Court except for the custody period of the petitioner, I am not inclined

8. However, the petitioner will be at liberty to renew his prayer for bail after six months if the trial is not concluded. (Ashok Kumar Pandey, J) Shubham/- U T
