This is the second attempt of the petitioner to seek bail as earlier the bail application of the petitioner was rejected vide order dated 21.12.2020 passed in Cr. Misc. No. 30754 of 2020.

Learned counsel for the petitioner submits that the Court vide order dated 21.12.2020 had given liberty to the petitioner to renew his prayer for bail if the trial is not concluded within a period of nine months. Learned counsel submits that in terms of the liberty granted, the present bail application has been filed and further draws the attention of the Court to the order dated 24.11.2021 whereby a report was called for from the learned court below with regard to the stage of trial. The report has been received vide Letter No. 140

Patna High Court CR. MISC. No.62163 of 2021(3) dt.23-03-2022 2/2 dated 26.11.2021 under the signature of learned Additional Sessions Judge-IV, Bhojpur at Ara wherein it has been recorded that the present stage of trial is at prosecution evidence but no evidence has been examined up till now in spite of issuance of summon upon the witnesses and specific direction to the prosecution for producing the evidence.

Learned counsel submits that despite specific direction by this Court to complete the trial within a period of nine months, till date not a single prosecution witness has been examined.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

In view of the report submitted by the learned court below and liberty granted to the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Charpokhari P.S. Case No. 173 of 2019.
