JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is languishing in custody since 20.7.2016 in a complaint case in which process has been directed to be issued after cognizance being taken under Sections 498A and 494 of the Indian Penal Code and section 4 of Dowry Prohibition Act.

The basic accusation is of torture for non fulfillment of dowry demands and performance of second marriage. It is submitted by the learned counsel for the petitioner that Complaint Case No. 2514 C of 2013 was filed on behalf of the petitioner as he was being kidnapped at the hands of the father

Patna High Court Cr.Misc. No.36243 of 2016 (2) dt.23-08-2016 2/2 of the complainant. It is further submitted that the Superintendent of Police got the issue of demand of dowry enquired and during enquiry it was found that the petitioner never demanded any dowry.

Considering the nature of accusation and the period in custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Khagaria in connection with Complaint Case No. 47C of 2014.
