The petitioner seeks bail in Bikram P.S. case No. 207 of 2009, corresponding to Sessions Trial No. 1188 of 2010, under Section 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.
Sri Rama Kant Sharma, the learned senior counsel for the petitioner, submits that prayer of petitioner for bail was earlier rejected by this court on many times. On 28.08.2015 when prayer of petitioner for bail was lastly rejected, direction was given to the trial court to conclude the trial within three months but the trial has not yet been concluded.
It appears from the order of learned court below that case of the prosecution has already been closed and the statement
Patna High Court Cr.Misc. No.371 of 2017 (5) dt.22-03-2017 2/2 of accused persons have also been recorded and the case is pending for evidence of defence witness but the defence has not produce any witness and that is why the case is adjourned on day to day.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
