The petitioner seeks bail in Ara Town P.S. Case No. 214/2012, registered for the offences punishable under Sections 307, 393 of the Indian Penal Code and Section 3⁄4 of the Explosive Substance Act.

The petitioner is not named in the FIR. Name of the petitioner figured in the case on the basis of confessional statement and during course of investigation some of the witnesses are said to have disclosed the name of the petitioner. It is submitted that the informant and other witnesses have claimed to identify the accused persons but the petitioner was not put on Test identification Parade. Nothing has been recovered from the possession of the petitioner. The petitioner is in jail since

Patna High Court Cr.Misc. No.55405 of 2016 (3) dt.01-03-2017 2/2 12.09.2016. He has already remained in jail about six months. Similarly situated co-accused Guddu Mian has already been enlarged on bail by a Bench of this Court.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S.
