JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-10-2018 The petitioner is in custody since 28.05.2018 in connection with Trial No. 498 of 2018 arising out of Kesariya P.S. Case No. 56 of 2006, registered for offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code. Allegation against the petitioner and other accused persons is of causing death of the husband of the informant. Petitioner is named in the F.I.R. Further it appears from impugned order that he was absconding for 10 years and the case is of the year 2007 and he surrendered on 28.05.2018.

Submission of learned counsel for the petitioner is that the other co-accused person having similar allegation has been granted privilege of bail by a Coordinate Bench of this Court vide order dated 12.02.2008 passed in Cr. Misc. No. 51895 of 2007 and

Patna High Court Cr.Misc. No.60666 of 2018 (2) dt.06-10-2018 2/2 the petitioner is in custody since 28.05.2018. Heard learned A.P.P. also, who opposed the prayer for bail of the petitioner.

Having heard both sides and considering the aforementioned facts and circumstances, I am not inclined to grant bail to the petitioner.

This application is accordingly dismissed.
