This is an application for bail in connection with Tribeniganj P.S.Case No. 122 of 2016 registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. It has been submitted on behalf of the petitioners that the petitioners are father-in-law and mother-in-law of the deceased and the allegation against them is that they along with husband and other accused persons strangulated the deceased. It has further been submitted that the post mortem report does not support the prosecution version, rather it appears that viscera report has not been sent up till now and the petitioners are in custody for more than eight months.

Having heard both sides and considering the aforesaid fact, let the petitioners, namely, Shiv Nr. Mehta and Bimla Devi, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Supaul, in connection with Tribeniganj P.S.Case No. 122 of 2016, subject to the conditions that one of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further the petitioners will co-operate in the trial and make themselves available before the court on each and every date fixed and in the event of failure on their part to appear before the court on two consecutive dates, except showing some genuine ground, their bail bonds shall be liable to be cancelled.
