Petitioners seek bail in Sanokhar (Amdanda) P.S. Case No.68 of 2020, registered for the offences punishable under Sections 328, 302 and 34 of the Indian Penal Code. Allegation against the petitioners is that the petitioners and other co-accused persons administered poison to the son of the informant.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case. It is further submitted that the independent witnesses have not supported the prosecution case, which is mentioned at
Patna High Court CR. MISC. No.9250 of 2021(4) dt.21-10-2021 2/2 paragraphs 39 and 40 of the case diary. The petitioners are in custody since 21.06.2020.
Considering the facts aforesaid, let petitioner no.1, namely, Doli Devi @ Doli @ Doli Kumari be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 10th Additional Session Judge, Bhagalpur in connection with Sanokhar (Amdanda) P.S. Case No.68 of 2020, giving rise to S.T. No.215 of 2020.
The prayer for bail of petitioner no.2 is rejected. Petitioner no.2 may renew his prayer for bail after framing of charge.
