29-09-2016 Heard Sri Jyoti Ranjan Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 14-07-2016 in Morkahi P.S. Case No. 72 of 2016 registered for offence under Section 188 of the Indian Penal Code and Section 47(A) of Bihar Excise Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the petition and on false accusation of recovery of 10 litres of country-made liquor, the petitioner was arrested. It was submitted that the liquor was not recovered from the conscious possession of the petitioner, but it was recovered from a hut, which was not in possession of the petitioner.

Patna High Court Cr.Misc. No.40860 of 2016 (2) dt.29-09-2016 2/2 Keeping in view the nature of accusation, clean antecedent of the petitioner and period of custody, let the petitioner namely Subodh Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Khagaria in connection with Morkahi P.S. Case No. 72 of 2016.
