Patna High Court CR. MISC. No.50813 of 2019(4) dt.04-11-2019 2/2 504, 341 of the Indian Penal Code and Section 3 /4 of Prevention of Damage of Public Property Act.
Petitioners are named in the F.I.R. along with others with allegation that they attacked the police party and damaged the public property and also committed arson and loot.
Submission of learned counsel for the petitioners is that is that the Block Pramukh was murdered and the police was not registering the case, due to which, a protest was carried on by local people, as such, petitioners and others have been made accused in this case. Moreover, no specific allegation has been attributed to the petitioners.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XI, Vaishali at Hajipur, in connection with Jandaha P.S. Case No. 200/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
