KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 20-02-2020 Petitioner has prayed for the following relief: "(a) To direct the respondent No. 2 to make enquiry either himself or through independent agencies with respect to misappropriation made by the respondent No. 5 while showing the construction of Latrine under the Scheme of Government. Although, no such Latrine Tank/building/Chamber has/had been withdrawn.

(b) To direct the respondents to lodge an FIR against the erring person who indulge in such illegal activities and misappropriated the pubic money." On 13.02.2020, we have passed the following order: "Petition was filed in the year, 2017.

Patna High Court CWJC No.2339 of 2017(4) dt.20-02-2020 2/2 Despite repeated calls, none appears on behalf of the petitioner. However, in the interest of justice, matter is adjourned.

Today also, none has entered appearance on behlaf of the petitioner.

We notice that it is a public interest litigation highlighting the inconvenience caused to general public on account of misappropriation in the construction of toilets. Affidavit filed on behalf of the respondents is taken on record.

Mr. Harish Kumar states that appropriate action already stands taken and recovery effected from the erring officers/officials/persons and FIR registered. In view of the same, we close the present proceedings reserving liberty to any public spirited person to initiate appropriate action before this Court, if so requires and desires, in accordance with law.

Petition stands disposed of.
