JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-05-2015 Heard learned senior counsel for the petitioner as well as learned counsel appearing on behalf of the Vigilance.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 420, 409, 467, 468, 471 and 120(B) of the Indian Penal Code and Sections 13/14 of Prevention of Corruption Act.

Learned senior counsel, appearing on behalf of the petitioner, has submitted that the petitioner was not named in the First Information Report, which contains

Patna High Court Cr.Misc. No.3036 of 2015 (3) dt.14-05-2015 2/3 allegations of financial irregularities and misappropriation of government fund by the ViceChancellor of Kameshwar Singh Darbhanga Sanskrit University. He has submitted that petitioner has subsequently been made accused only on the allegation that he withdrew the House Rent Allowance while availing the facility of accommodation provided by the University. He has further submitted that L.N.M.U. P.S. Case No. 126 of 2010 (Special Case No. 14 of 2011) was instituted against the petitioner with the allegation of availing facility of such House Rent Allowance in which, the petitioner has been granted the privilege of anticipatory bail. Learned senior counsel has submitted that over and above this, there is no allegation against this petitioner.

In view of the submission made on behalf of the petitioner by learned senior counsel, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned
