JUSTICE SUDHIR SINGH ORAL ORDER 03-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 347, 307, 34 of the Indian Penal Code later on Section 302 of the Indian penal Code was added.
The allegation, in brief, is that while the brother-in-law of the informant was returning back from the market then Akshya Kumar Bind assaulted him with Lathi and Vishnu Bind and Jimani Devi, both accused also turned up and started assaulting him with first and slaps as a result of which he became unconscious, he was brought to Durgawati Hosptial and it is alleged that he succumbed to the injuries.
Patna High Court Cr.Misc. No.23429 of 2015 (3) dt.03-09-2015 2/2 On behalf of the petitioners it is submitted that the petitioners are innocent and have falsely been implicated in the present case. From perusal of FIR it would appear that the allegation against the petitioners is of assaulting the deceased with fists and slaps. It is further submitted that petitioner no.2 is a lady. It is also submitted that the main allegation is against Akshya Kumar Bind.
On behalf of the State, it is submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua in connection with Durgawati P.S.Case No. 45 of 2015, G.R.No. 565 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
