JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 387/34 of the Indian Penal Code.
The prosecution case is that while the informant was constructing wall on a purchased land the petitioners came and demanded extortion of Rs. 1.5 lacs.
It is submitted by learned counsel for the petitioners that the land was purchased by the informant from the grand-father of the petitioners but one Arjun Prasad Singh also claimed the title and filed Title Suit No. 20 of 2008 in which the petitioners deposed against the informant hence as a retaliatory measure, the petitioners have been roped in the present case. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Saharsa P.S. Case No. 506 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
