JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sadar Police Station Case No. 428/2016 registered under Section 420 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

Accusation is that on receiving secret information about transporting the Sub standard fertilizer to the agriculturists, the informant being the Block Agriculture Officer, Purnea reached near Shiv Temple Road, Gulabbagh .On the basis of suspicion, he stopped one Mini Tempo in which four persons including the petitioner were apprehended and after enquiry they disclosed that

Patna High Court Cr.Misc. No.2078 of 2017 (2) dt.23-01-2017 2/2 he alongwith others were transporting mixture of inferior quality of fertilizer for selling among the agriculturist and seizure list of fertilizers was prepared.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that the petitioner is a driver of the tempo and has no concern about the said fertilizer. The petitioner has no criminal antecedent and he is in custody since 05.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner namely Md. Rajib is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnia in connection with Sadar Police Station case No. 428 of 2016.
