The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307/506 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case as per F.I.R is that all the F.I.R named accused persons including the petitioner surrounded the house of the informant and started firing

Patna High Court CR. MISC. No.58921 of 2023(3) dt.07-11-2023 2/3 as a result of which, the sister-in-law(Bhabhi) of the informant sustained gunshot injuries on her legs. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. There is counter version of the occurrence also and petitioner's side also sustained injuries. Nothing has been recovered from the conscious possession of the petitioner. Moreover, the injured sustained gunshot injuries on the non-vital part of the body. The petitioner is languishing in custody since 27.04.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In contra, learned counsel appearing on behalf of the informant and learned A.P.P for the State have vehemently opposed the prayer for bail of the petitioner. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be
