Having regard to the fact that the present writ petition, made under Article 226 of the Constitution of India, in the form of
Patna High Court CWJC No.8852 of 2015 (3) dt.02-02-2016 Public Interest Litigation, involves disputed question of fact, the Public Interest Litigation is not an appropriate proceeding. In view of the above, this writ application shall stand disposed of with liberty granted to the petitioners to take recourse to provisions of Section 133 of the Code of Criminal Procedure and/or to institute appropriate suit in a civil Court of competent jurisdiction.
