JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 47(A) of Bihar Excise (Amendment) Act, 2016.

One bottle containing 375 ml. Indian made foreign liquor was recovered from possession of petitioner no. 1 whereas one bottle containing 750 ml. Indian made foreign liquor is said to have been recovered from possession of petitioner no. 2 for which petitioners are in jail custody since 19.05.2016 without having any criminal antecedent.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.31566 of 2016 (2) dt.12-08-2016 2/2 well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 75 of 2016.
