The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

720 Ml. of foreign liquor has been recovered from a Bolero vehicle.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the vehicle in question and nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks

Patna High Court CR. MISC. No.52962 of 2022(2) dt.11-11-2022 2/2 from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. 1, Muzaffarpur in connection with Minapur P.S. Case No. 326 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
