The petitioner seeks bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 24 litres illicit liquor was recovered from a bag belonging to the petitioner. It is further contended that petitioner has committed no offence and she has falsely been implicated in this case only by showing false recovery of 24 litres illicit liquor. Petitioner claims that she is having clean antecedent and is in custody since 03.08.2018.
Having regard to the facts and the circumstances of
Patna High Court Cr.Misc. No.59280 of 2018(2) dt.06-10-2018 2/2 the case, the abovenamed petitioner is directed to be released on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Spl. Judge, Excise Act, Muzaffarpur in connection with Muzaffarpur Rail P.S. Case No. 143/18. Further, if the petitioner, after her release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of her bail bond.
