JUSTICE SUDHIR SINGH ORAL ORDER 21-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 419, 420, 406, 467, 468, 471 and 120B of the Indian Penal Code.
Allegation against petitioner is that he has taken huge amount from informant on the basis of false promise of his placement as Development Officer in the bank It has been submitted on behalf of petitioner that he has falsely been implicated in the present case. He is in custody since 1.9.2016. Chargesheet has been submitted against petitioner. As per F.I.R., outstanding dues against petitioner is Rs.3,73,700/-. He has been made accused due to mistake of fact. It is further submitted that petitioner is ready to deposit an amount of Rs. 1,50,000/- in the court below within a period of one month from the date of his release. The said deposited amount may be released in favour of informant by the court below. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.50276 of 2016 (2) dt.21-11-2016 2/2 above named petitioner be released on provisional bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul , in connection with Supal P.S. Case no. 163 of 2014.
Petitioner is directed to deposit an amount of Rs. 1,50,000/- in the court below within a period of one month from the date of release which shall be released in favour of informant. On deposit of the said amount, the provisional bail of the petitioner shall be confirmed.
If petitioner fails to deposit the said amount, the court below will be at liberty to cancel bail bond of the petitioner and shall take necessary steps to secure his appearance in the case. (Sudhir Singh, J) sudip/- U T
