Petitioner seeks bail in a case registered under sections 272, 273 of the Indian Penal Code and section 47(A) of the Excise Act. 80 bottles containing 300 ml. each Nepali liquor are said to have been recovered from the possession of co-accused Gopal Manjhi and so far as the petitioner is concerned, he was also with the aforesaid co-accused Gopal Manjhi but admittedly, nothing has been recovered from the conscious possession of the petitioner. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Raxaul, Motihari in Chhauradano P.S.
