The petitioner wants to renew his prayer for pre-arrest bail which has already been rejected by order dated 30.01.2015 passed in Cr. Misc. No. 31493 of 2014 on the ground that in this case other co-accused have already been granted pre-arrest bail vide Cr. Misc. Nos. 33937 of 2014, 34288 of 2014, 31558 of 2014 and 20755 of 2015 and from their houses more live plants of ganja were recovered and further the place from where the ganja plants were recovered is not the place of residence of the petitioner. The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail by another Bench of this Court.
In the facts and circumstances as stated above and further considering that the petitioner has got no criminal
Patna High Court Cr.Misc. No.27211 of 2015 (2) dt.24-06-2015 2/2 antecedent, he in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail till conclusion of the investigation on executing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Munger in connection with Barbigha P.S. Case No. 20 of 2014 subject to the conditions as laid down in section 438 (2) of the Cr.P.C. The bail bond of the petitioner shall be accepted by the learned court below on filing an affidavit to the effect that he shall regularly cooperate during investigation. The said affidavit will be transmitted to the concerned I.O. The non cooperation in the investigation will give liberty to the learned court below to cancel the bail bond of the petitioner.
