Petitioner seeks bail in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code and Section 27, 25(1-B)A, 26 of the Arms Act. Allegation, in brief, is that unknown miscreants committed dacoity in the house of the informant. Submission is that name of the petitioner is disclosed in the confessional statement of co-accused Jitu @ Jita @ Kabindra Chauhan and there is no material against the petitioner and he is in custody since 18.06.2018. It is also submitted that neither any incriminating material was recovered from possession of the petitioner nor he was ever put on T.I.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Laheri Police Station Case No. 240 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below.
