Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Hajipur Town P.S. Case No. 694 of 2020 registered for offence punishable under sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

The informant is own brother of the petitioner. As per allegation, the petitioner transferred the land of the informant in favour of one Jugeshwar Rai and Ramshlok Rai. The learned counsel for the petitioner has

Patna High Court CR. MISC. No.62920 of 2021(6) dt.12-09-2022 2/2 submitted that the petitioner is a person of clean antecedent. Both the parties are own brothers. The land mentioned in the FIR belongs to the share of the petitioners and if it is determined in civil dispute that the land in question falls in the share of the informant, the petitioner would be ready to cancel the sale deed. Considering the above-mentioned facts and circumstances and also considering the clean antecedent of the petitioner, let him in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 694 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
