The application is for grant of bail for the offence under Sections 395 and 397 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner is not named in the First Information Report. His name transpired during the course of investigation in the confessional statement of the co-accused. Nothing has been recovered from the possession of the petitioner. The petitioner has not been put on Test Identification Parade nor chargesheet has been submitted. It has further been submitted that he is in custody since 20.06.2016.

No.54996 of 2016 (2) dt.22-12-2016 2/2 Having heard both sides and in view of the fact that the submission made by the petitioner could not be controverted by the learned A.P.P., let petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Madhubani in connection with Khajouli P.S. Case No. 81 of 2016.
