JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 20.09.2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Dhaka P. S. case no. 266/2018 registered under section 30(a) of the Bihar Prohibition & Excise Act.

Informant claims that 1900 bottles of Nepali liquors were recovered from the house of Suraj Manjhi and the informant got secret information that the petitioners used to supply country made liquor.

Admittedly, nothing has been recovered either from conscious possession or from the house of the petitioners. Para 3 of the petition goes to show that the petitioners do

Accordingly, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the 7th Addl. Sessions Judge-cum-Special Judge, Excise at Motihari, East Champaran in Dhaka P. S. case no. 266/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
