Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a)/32(3) of Bihar Prohibition and Excise Act, 2016.

Recovery of liquor is alleged from a Bolero vehicle. Petitioner was pillion rider on motorcycle and allegation is that the liquor was of the petitioner. Petitioner has got identical criminal antecedent under the old Excise Act. Petitioner is in custody since 10.06.2019.

Considering the facts of this case aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court

No.50563 of 2019(2) dt.22-08-2019 2/2 below where the case is pending in connection with Bithan Police Station Case No.41 of 2019 arising out of Computer Registration No.682 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
