JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 436,323,379,376/511 of the Indian Penal Code. It is alleged against the petitioners that when the informant foiled the attempt of petitioner no.2 to establish forceful physical relationship, the house of the informant was put on fire.

It is submitted by the learned counsel for the petitioners that the accusation was found false and chargesheet has been submitted under sections 341,323,354 and 504/34 IPC and

Patna High Court Cr.Misc. No.23966 of 2015 (2) dt.09-07-2015 2/2 accordingly, cognizance was also taken under the same provisions of the IPC. It is further submitted that the informant being neighbour of the petitioners is in habit of lodging such cases and at earlier point of time the informant had lodged several cases against the petitioners in which the petitioners are on bail. More over the accusation was initially ventilated through complaint though subsequently police case was registered on 16.1.2014 for the occurrence of 15.12.2013.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Banka in connection with Rajoun P.S. Case No. 16 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
