JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 364/34/120B of the Indian Penal Code. Petitioner is not named in the first information report but it appears from perusal of the case diary that in course of investigation, petitioner was taken into custody on mere suspicion and on the basis of his disclosure, some fire arms were recovered from his house. So far as recovery of looted Scorpio is concerned, the same has not been recovered as yet and the dead body of the deceased was recovered at abandoned place. Learned counsel appearing for the petitioner submits that except so-called

Patna High Court Cr.Misc. No.35047 of 2016 (3) dt.22-10-2016 2/2 confessional statement, there appears to be nothing against him and moreover, co-accused Deepak Kumar and Jitendra Kumar have already been granted privilege of bail by other Benches of this Court.

No doubt, petitioner carries criminal antecedent but in the present case, except suspicion, there is nothing against him. The investigation against him has already been completed. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J.-1,Samastipur in connection with Samastipur Muffasil P.S. Case No.40 of 2015.
