2. The petitioner seeks bail in connection with Agiaon (G) P.S. Case No. 198 of 2024 dated 23.11.2024, instituted for the offence punishable under Sections 96, 3(5) of the B.N.S.
3. The prosecution case, in short is that on 17.11.2024, the informant along with her daughter had gone in a marriage ceremony. After sometime, the daughter of informant returned home. Later, when the informant reached her house, she discovered that her daughter was missing. The informant
Patna High Court CR. MISC. No.52731 of 2025(3) dt.15-11-2025 2/3 searched her but could not find her. She suspects that the petitioner has kidnapped her daughter with the help of Munna Bharti and Guddu Bharti for the purpose of marriage.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that statement of the victim was recorded under Section 183 of the B.N.S.S. in which she did not support the case of the prosecution. Learned counsel further submitted that co-accused Manu Bharti and Guddu Bharti kidnapped the daughter of the informant and took her to Buxar. Thereafter, Arjun Giri took her to Ludhiyana and forcefully married her. It is next submitted that there is no evidence of any overt act by the petitioner. Lastly, it has been submitted that the petitioner is in custody since 21.01.2025, he has no criminal antecedents and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional
